Repo Company Harrassment
My wife purchased a car in FL, from a buy here pay here dealer, original price was $6000, paid the note for 2 years, asked for account audit to determine payoff amount, as according to our calculations it should have been paid off. They refused and said we still owe around $500, we said ok prove it, print us out a payment report, which they would not do. So we stopped paying. A couple of weeks later i see my mail box is knocked over and broken in two. My neighbor tells me that he saw a tow truck back into it and keep going. Thats when we start getting calls from the repo company about how they need the car back etc. (car is undriveable and is actually at a repair shop for tranny problems). Next we get a letter from a collection agency, as well as phone calls, the person is actually the same repo man that had started harrassing phone calls earlier. We also got a letter from an attorney during the same week, stating that this is a debt collecton attempt etc. The letter ends by explaining what to do if you dispute this debt etc. I follow the instructions on the letter to dispute it, in writing, and send a copy to the lawyer as well as the collection agency,
a little over a month later I get a hand written payment history from the dealer, and a letter stating that they have proven that we still owe the $500. Not only was it hand written it was not even a copy, the morons sent me the original. I sent another letter to the attorney stating that no one has provided proof that we owe this debt , and please be advised we still dispute this, and please provide us with proof. 3 momtns latter we have not heard from anyone. My question is how can i get the title for this car. I know we dont owe them $500, our receipts total over $6000.

Q: My question is how can i get the title for this car.
A: Pay the loan off. (Well...at least that's always the way I did it.)

Did you read my post I am disputing the debt, they have to provide proof within 30 days do they not?

I answered your question legally, accurately, and, best of all, for free.
You have caused yourself thousands of dollars worth of damage arguing over $500.

From what you say, they're not a collection agency, but instead they're your original creditor. The FDCPA does not apply.

They are a collection agency the letter head states this. By the way I am glad you are still not a practicing judge, very sarcastic bloke. I dont expect any real help here, I will cancell my "membership"
