Default A Father Wants to Establish Paternity And Get Custody
I have a baby with a woman who was mutual seperated with her husband, but come to find that she is still legally married.
The baby has been with me the father since being discharge from hospital. The mother does not suppot the baby in any way. She has not seen her daughter in a month. All financial and emotional support come from me the father. Since we are unmarried and the mother is still legally married to her husband, I have come to find that I both do not have legal custody or many parental rights. For example, even though I made a paternity claim for the baby before being discharged, I do not have right to obtain any records or have my name on birth certificate. I currently don't communicate with the mother and I need to have access to records to get things like medical insurance. In addition, most place like WIC, pediatrician and insurance requires the mother (Legal Guardian) to filed for it.
I need to get sole custody because the mother is not responsible and has failed to support her child in time of need. I want to know what are my rights and chances of getting sole custody and possible child support.

Default Custody Problem
If the child is in your custody and the mother is not paying support or having regular contact, your chances are probably quite good. Consult a family lawyer about petitioning for custody.

Default Paternity Dispute
Thank you for your help
Being that the mother is still married doesn't she have the right legally to take my daughter back and get child support from me even though i have been taking care of my daughter
I've been doing research, and it seems like judges are leanient toward the mothers side. Also it is rare that an unmarried father seeks custody or child support would the judge really give it to me.
