Default Criminal Protective Order for Domestic Violence in Santa Clara County

2 years ago my mother and father placed a protective order on a good friend of mine to stay away from me. He is also on probation for 3 years and so is the protective order. I am now 18 but the protective order does not expire until next year. My questions are

since i am now 18 can i talk to him again?

And on the second page of the protective order explaining the terms it reads under effective date and expiration date of orders

-Orders under penal code section 1203.097 are probationary orders and the court has jurisdiction as long as the defendant is on probation
-To terminate this protective order use form CR-165. Notice of protective order in criminal proceedings(CLETS)

With what i quoted above on the first bullet, does this mean i have absolutely no say in removing the restraining order? But as i quoted in the second bullet wouldnt i be able to fill out the CLETS form and the restraining order would be invalid now?

thanks again for all the help

    -Rachel

Default Re: Criminal Protective Order for Domestic Violence in Santa Clara County

If he's subject to the protective order as a term of his probation, whatever your age, if he violates it he can face both sanctions for violating the order and probation violation proceedings. If he wishes to seek modification of his probation, he can discuss it with his probation officer.

As for your second point, no. You don't get to fill out that form (CR-165) - it is a standard form order which a judge would sign.
