Mom trying to get the babies back...

I am 21 yrs. old and I have had the pleasure of raising to beautiful children for the past 2 yrs. A girl (2) and a boy (4). There parents split up almost three yrs. ago and the father was given custody of the children (joint decision between parents). The mother has only seen the children a handful of times in the past two years and doesn't call often. She was living about 20 minutes from us and then moved almost 8 hrs. away. We have since moved closer to her since the children's father has gotten out of the marine corp. We have had our ups and downs with the mother between her drugs, partying, and suicide attempts...Now she is supposed to be joining the military (she came up pregnant ....another abortion) she was going to terminate her rights to join the Navy, but they supposibly found a loop hole. She hasn't paid child support in 2 yrs. except once last February. Now her and her mother are threatening to try and take the children What can we do. What do we need to do?

The father can answer and oppose any motion to modify custody. The facts you provide indicate that the mother would have only a slight chance of getting custody, at best. Of course, her version of events may be different.

If you wish to formulate a plan for the possibility that she might seek custody, you should consult a local family lawyer. It's really hard to give you any concrete suggestions in relation to what could theoretically happen in the future.
