    Default Bicyclist Hit By A Mirror

    My Brothers son was riding his pedal bike home last week and went to make a turn and was hit by a trucks mirror. The guy told him just to pay for it , He just got a letter in the mail for over 600.00 for the door. to. It was only a tap who at fault they both were making a turn an the driver ststed he did not see the bike
    this happehed in Phila. Pa.

    they hit each other , who has the right of way ? and now it went from paying for the mirror to door damage,that who knows who did.

    No way to know ... who was traveling in what direction? What mirror was hit and by what part of the bicyclist?

    Without a 'picture' of what happened, it's anyone's guess. I can conceive of more scenarios making the bicycle at fault than the motor vehicle, but that does not mean that is the case here.

    Besides, the question of who is at fault is moot. Unless they go to court (small claims for the mirror, I suppose) or an insurance claim is made, it really doesn't matter. If your brother refuses to pay for the mirror, the other guy can try to sue in small claims court ... THEN he would have to bring out diagrams and try to explain the scene and argue why his boy was not at fault. Until then, it's entirely up to him whether he thinks his boy was at fault or not, and whether he wants to pay up.

    "Fault" can also be a subjective issue as a person who is most at fault based upon state law may NOT be assigned that fault in its entirety by an insurance company or a civil court.

    Ultimately, what does your brother think?

    Agreed. More information on how the accident occurred is needed, along with the state. AND, does your brother have auto insurance?

    The state was PA ... per his original post it was in Philladelphia.

    I miss these things too often myself.

    In PA, the boy on the bike should file a claim on his parents insurance policy for any medical. But, without additional details, we can't help in determining fault.
