    Default Going to Court for Visitation Rights Without the Custodial Parent's Knowlege

    OK, I'm pretty sure I know the answer to this, but I can't find anything to confirm it. I live in Massachusetts, and am currently going through a dispute with my son's father. I have documented cases of abuse, and a social worker currently investigating him. Because we were never married, I currently have custody of our son - at least until we go to court. Things with him have gone from bad to worse over the past 2 months, when I first spoke out against the abuse (physical, verbal, emotional) that I have experienced over the past three years. I told him until the investigation is complete and a judge says otherwise, I don't want him to be around our son unsupervised ("Dad" frequently shoves/hits me, puts holes and walls, and slams our young son down when he's angry). Well, now Dad says he went to court months ago for a custody agreement/visitation rights. This sounds completely absurd, and I really don't believe it. However, just to make sure, is there any way possible that he DID go to court and get visitation rights without my knowledge? Thanks!

    Have you recently moved? If not, no it is not very likely but a good way to check would be to go to the court and see if there is anything on file about it.

    No, I have not recently moved. How would I go about finding out if anything is on file? Thanks!

    You would check with the court where the custody order was entered. Some courts even have online case calendars where you can check activity on a case.

    Make sure that you are in compliance with any requirement to keep the court informed of your current address.
