Default Vehicle Not Picked Up After Default
Hello, this forum is quite interesting so I thought I'd ask a question that's been bothering me. I moved to Texas from Oklahoma over a year ago. I drove here in a vehicle I bought in Okla. there has been no payment made on the vehicle in well over a year. In fact, I was slapped w/ a repo (obviously). But here's my dilemma....I was able to purchase another vehicle even though I have that repo on my credit, thank goodness (in an attempt to help re-establish my credit). I tried contacting the lender to advise them to come pick up the vehicle but was told it had been turned over to an attorney's office. I tried contacting the attorney's office more than a few times but NEVER got a response. I did some more digging and found a claim for indebtedness had been filed against me on 2/23/2007. However, my credit report shows the debt has been paid (I assume by the lender) and has since charged off. Again, the attorney's office HAS NOT contacted me back and I was thinking of sending them something certified mail to exhaust ALL resources....I really want them to come get this car--therefore, my questions are.
1. can I go to jail for this?
2. my attempts to contact atty....had no such luck and they won't call me back.
3. I'm sure they could have found me by now (it's been over a year and the car just sits at my residence) why haven't they?
4. have I gotten off scott free w/ this vehicle? what should I do with it?

It sounds like you obtained financing from the outfit where you bought the car, and that they aren't particularly coordinated at dealing with interstate repossession.

For what? A repo is a civil matter, and you say that you're not doing anything to prevent recovery of the car - quite the opposite.

No, you haven't, as there is a lien on the title. You can't sell it, and even disposal is likely to be a problem. Further, the lender can try to collect on your debt.

Again, it's obvious to me they aren't interested in picking up the vehicle since they haven't bothered returning my calls, nor have they exhausted the resources of our technology today ie. skip tracing to see that I work in Texas, live in Texas, therefore have a Texas address.
I will not worry myself silly about returning the vehicle since I don't know who to return it to. The lender that approved my loan initially informed me they no longer have anything to do with (they turned it over to the attorney's office). With that said, I feel I have made a valiant effort to return an "unwanted" vehicle.

You are still responsible for the loan. They will keep adding interest and costs. Send the original creditor a letter CRRR stating you want to do a voluntary repossession and requesting where you can turn in the car.
