    Default Fence Damage by Town DPW

    Hi

    I recently placed a fence at which sits about 1.5 ft. back from my property line at the end of a street. I am planning on informing the town before the snow plowing seasons starts so they are aware of it.
    But if the town damages my fence I assume they are liable? There is no immunity that a town can have?

    You would need to follow any permitting requirements and applicable ordinances when erecting your fence. Beyond that, laws are different in each state.

    I asked the town before I built it and they have no ordinances for set back, style, etc. Only if built higher than six feet there are rules, but this is a 4ft high fence.
