    Default What If You Pay the Last Month's Rent Upon Moving In

    I'm in a rent controlled apt. in CA and lived under one landlord for 5.5 years and a new one for this past year.

    Upon move-in in 2001, I paid $2799:
    1000.00 for first month
    1000.00 for LAST month
    500.00 for deposit
    299.00 for proration of days from 6/22-7/1 (moved in early)

    My initial lease has the total amount paid as $2799.00 "which is pro-rated rent through July 2001. Next rent will be due 8/1/2001."

    It also states that the deposit was only $500.00

    I am giving a 30-day notice of intent to vacate my premises tomorrow on 10/1/07 and am curious, DO I HAVE TO PAY RENT IF I PAID THE LAST MONTH'S RENT UPON MOVE-IN?

    Since then, the rent has been increased...so can I just pay the difference of the increase plus the pro-ration of any days that overlap into November? Or do I have to pay my rent in full and struggle to get the money back after the fact? I have a feeling this new guy will try and take the $ and imply it was a deposit.

    No, it has been prepaid. But, be sure to remind your LL, and present a receipt if possible.
