Default Help with Aggravated Assault, Domestic
I was involved in an altercation with my ex-partner in my own home in Tennessee. I ended up being charged with domestic aggravated assault by the responding police officer because I used a lamp to defend myself after he shoved me into a wall and I hit my head on the door frame almost knocking me out. My ex claims I hit him in the head with the lamp. I don't remember hitting him but I do remember picking it up. I was totally blindsided by this charge. I felt as though I was defending myself. I was even told that I could not return to my home which I own because he still resides there.

Over the past year my ex has broken my ribs twice, split my face open with his fist twice, kicked me in the face with a boot, and caused an orbital blowout fracture in my right eye. I only sought medical treatment once and went on my own explaining to the physician that I had been in a fight with a friend. I was asked if I wanted to make a report and file charges. I said no because I did not want to get him in trouble and he promised it would not happen again. My friends told me that I was stupid for not at least telling the dr why I was hurt because I might need the documentation some day.

I am going to hire an attorney as I know that I need one. My question is, based on this information, do I have a chance in being found innocent of the charge? My ex is a trained soldier. I am not. Does this make any difference? I don't understand why that when I finally fight back I am the one arrested and put in jail. Any help here is appreciated.

If you hit him with the lamp, it is reasonable to infer that he would have a bruise or other injury at the point where you hit him. Did he?
