My son was shoved to the ground by a parent (6'-3" 230 pounds) when all the kids were playing up at the cottage and when I came over to see why he was crying the parent said "you're lucky your son is still alive". According to this parent my 6 year old son pushed his daughter off the inner tube they were all playing on and this is how he resolved the situation. Since, then he has told his daughter to "stay away from that little boy, he's a retard" and my son was close enough he could hear him say that and he is extremely upset over it. My son has never been in trouble at school and is a straight A student and shows great respect to adults and gets along with everyone.
My wife and I are very concerned if we go back to the cottage and this neighbor is there. We got into a verbal shouting match when this happened and we don't trust this guy one bit around our child.
What can I do to protect my son and other kids from this guy?
Restraining order?
Charge him with assault?
His brother in law saw and heard everything and is willing to back me up 100% and give a statement or affidavit to verify everything.
To further complicate things I live in IN and he lives in MI and the cottage is in MI.
This guy has a loaded gun with him at all times and bought his 4 year old daughter a 22 rifle for her birthday.
If you wish to file a police report, there is no reason you can't do so. At some point, if charges are authorized, you would have to be prepared to travel (with your child) to the county in Michigan where this occurred to be a witness for the prosecution.
