Arrow Married to Someone Who Is Already Married For Immigration Purposes

I had recently just gotten married, and a few days ago I had just found out that my new husband is already legally married to someone for immigration purposes. He's a US citizen who'm had married a family friend a few months back. From what I have found out, he had filed a k1 visa for her back in 2005, arrived here the begining of this year, married her within the time frame, filed for I-485, and got approved a month ago, all of which he had managed to keep this hidden from me, how he managed, I do not know. At the same time that it was going on, we got pregnant in 2005, had our first born in 2006, bought a car and renting a place together, got married legally a month ago (had no problems obtaining a marriage license), and expecting our second child in january.

My questions are, 1) how far do they investigate immigration marriages? She's already been approved for her green card. Do they still do an ongoing investigation, and how deep do they investigate this? Do they look through all the public records? 2) What are the consequences for not only him but me? I've been a permanent residence for 19 years and Im in the process of becoming a citizen, made it just in time before the fees went up. Would they do an investigation on me too if they found out?

I already know that not only did he comitt fraud, but also poligamy. No matter what, im sticking by his side. I know his actions were bad decisions on his part, but I also understand that he was helping out not only a family friend, but also his family as well. We are in the process if finding a lawyer, but I want input from others as well.

First of all, just so there is no mistake you are NOT legallly married to this man. Since he was already married, it automatically makes your marriage void. It doesn't matter that you were able to get a license or not. I know it has only been a month, but everything you have signed or attested to as a "married" is now automatically invalid and will be. So dont enter into any type of contract with this person as "married"

Now that you know this person is engaging in Marriage Fraud, anything you do, no matter how small, will be considered aiding and abetting Marriage fraud and could very well jeopardize YOUR citizenship. Did you fill out the final forms as married to him????

The new rules for permanant residency makes it a two year condition. After two years, they will have to apply to remove the conditional part. It is similar to the process for the original, they will have to show proof of their life together during those two years. Again, think about this. This man will have to enter into contracts, (Rental, lease, electrical bills..etc) The assumption is fraud and you have to prove it is real.

well, since you are so willing to assist in this illegal activity, I suggest you get a very good attorney to assist you in your deportation hearings since the fact you are knowledgable of the crime and willingly assisting him, you are as guilty as he. Criminals tend to have a difficult time being granted citizenship, especially when they willingly continue the act.
I am not an attorney and any advice is not to be construed as legal advice. You might even want to ignore my advice. Actually, there are plenty of real attorneys that you might want to ignore as well.

There are quite a number of people make money off of "helping" a non-citizen in getting citizenship by marriages. INS officer will set up meetings with the married couple in two years in questioning the validity of their marriage. Numerous questions will be asked during the interview, questions range from "who sleep on which side of the bed?" to "what kind of toothpaste the wife uses?" As immigration fraud is becoming more and more prevalent, INS' s investigation of marriage fraud is both thorough and harsh. Those that are involved will be questioned, charged, fined, and/or even jailed.

I was married on June 19, 2007 to an illegal immigrant, I am a born U.S citizen. This man came in this country from Guyana without inspection in 1995, he is on the deportation list. I found out that his first wife with whom he married in 1999 put in for his citizenship also but after she caught him cheating she withdrew the paperwork and they seperated. I found out later that his divorce to his first wife was not final until February of 2007. He moved to Florida in 2002 with his girlfriend, and everything he owns is under the girlfriend's name. He left his girlfriend because she was threatening to report him to immigration. We met each other in 2007 I thought that he loved me and truly cared about me but all he cared about was his citizenship. Two months after our marraige he left me and moved back in with the girlfriend and wanted to pay me $8,500 to pretend we were married to get his citizenship. I told him I would not do it because I respect the sanctity of marraige and if I knew this was a fradulant marraige I would have never married him. I divorced him on Sep 28, 2007. Please be careful of these fradulant marriages. Some of these illegals are desperate to stay in the country and they will do anything and say anything to get a citizen to marry them. Alot of people are being hurt because of these marraiges. Warning!!
