Default Battery of a Spouse
I was arrested for battery. My wife and I had heated argument and I ended up hitting her 3 times. She was upset and getting hysterical. I dont know how to stop her, I felt bad and I called 911 and admitted hitting her.

The police talked to her she and I admitted. The police arrested me. She bailed me out.

The officer kept telling me and wife that "it is highly unlikely that the DA will press for charges".

Can I just believe him or should I hire an attorney just in case.

Hire an attorney. You will be charged. With what will depend on the extent of your wifes injuries.

Also find a GOOD counselor. Your wife should too. Go at LEAST once a week. If you drink or do drugs, stop! Get separate help for that through AA or NA.

BTW: Hysteria and or anger are the natural reaction to an assault by someone that took a vow to cherish you.

It may be likely that the DA might not file in the case ... some DAs don't. But, you can't afford to take that chance. Consult an attorney, and get some anger management and marriage counseling ... I doubt you will do either, but if you were serious about your guilt and you want to keep this from happening again, you would.

It's all up to the DA's office, which means you cannot rely on the police officer's comment. For situations like this, you'd be better off having an attorney by your side. If the DA is going to press charges, it is serious. Seek marriage consultation is a plus, as heated arguments are always the product of both parties.

This happened in FL. My wife asked the investigation team considering that I am senior citizen with medical problems, can they reconsider the charges. It seems they might not move forward.
