I live in Florida with my mother, she took home equity for her home worth about $25,000 dollars. She was to make payments each month and got behind on payments by about 3 or 4 months due to health issues in which she couldn't pay all the bills. Yesterday a courier delivered papers that basically said she was being sued and has 20 calender days to respond for a court to hear her side of the case.
And attorney has already been assigned as well as a case number.
It also mentions the lawsuit is against my mothers name and (Unknown Tenant no. 1 and unknown tenant no 2), there are 3 people in our household so I don't know if that means I am included or not. The courier also asked for my name.
In the lawsuit it says
COUNT II
MORTGAGE FORECLOSURE
I talked with a lawyer and they said that my mother must respond within 20 days to the letter because in Florida if you do not, she will automatically lose and the house will be foreclosed.
My mothers boyfriend has been speaking with the loan company to negotiate and they had claimed that if she made a $1500.00 payment, they would reinstate her and end the lawsuit. The lawyer also told me to make sure she gets it in writing. Any other suggestions?
