Ex- Is Late In Paying The Property Settlement

I am a divorcee from florida. I was to recieve 1/2 of 401k and 1/2 of property worth and home value. I was to recieve this 90 days from when divorce was final.Sept.21 of 2006. I still have not recieved anything.I know that there is a thing called lache or statue of limitations and I dont know what I should do. I dont want to have to deal with my ex and tick him off by getting him with contempt of court but I was also awarded all the debt from credit cards we used for vacations and stuff bought for the home in excess of 20 thousand and I could really use the money for this.Thank you If you could give me some info on where to go or what to do I would greatlly apreciate it. I dont want to have to deal with my ex and tick him off by getting him with contempt of court but

if you don't want to deal with the ex, how do you expect to get what you are entitled to? With that attitude, you might as well forget about collecting because "dealing with the ex" is the only way you are going to get your money.

What I meant about dealing with ex was he has a very mean temper and I would like to handle it without him going to jail if I could.I just dont have a mean attitude and thats probably why I'm where I'm at now.

You are afraid to stand up for yourself and ask for what you are entitled to receive?

Did you have an attorney? That person can use the court to pressure him.

If you want to file with the court yourself you will need to learn how and what documents to file. Is that what you mean?

If you need counseling or protection that is another matter.

Sometimes you have to be very blunt with your questions if you want direct answers. Otherwise we don't have a clue about what to tell you.

Sorry you are right.First time asking for advice on internet.Had lawyer wasn't very helpful.His paralegal and I did all the work and he cost a pretty penny. He closed my case before I recieved anything from husband.Did not know if he was still supposed to help me or not.Right now cant afford to hire anyone.My Question I guess is How long do I have to get someone to help me collect all that I was awarded from the court.

If the judgement was in Florida and you both still live in Florida there is a 20 year statute of limitations.

If you are trying to collect on something partially paid to you, you may need to have paperwork rewritten and submitted to the court.

I advise you not to procrastinate. Circumstances change.

If you cannot afford a attorney who charges an hourly rate attempt to find someone who will accept a percentage as fee. If you need assistance in finding legal counsel, try contacting your local bar association or woman's law center.
