    Default Can You Beat a Charge Based on an Error in Your Court Date

    i recently recieved a citation for drug possesion of under 1/2 ounce, was more like under 1/2 of a gram, and paraphernalia...however, there were some errors on mine and my friend's tickets that i am wondering effect anything...first off i am 18 years old and my friend, who recieved the same citation as me, is 15...now i am told that he is not allowed to recieve a citation because of him being a minor, but they wrote 16 on his ticket...also we both told the cops that everything that was found was his, but the cop wrote me a ticket because it was found in my vehicle at the time...also errors on my ticket include the court appearance date is listed as thursday, November 25, 2005....if you will notice the 25th is a friday, not a thursday, and also the day of Thanksgiving...i don't even know what date to appear on so i am wondering if this may be able to get me off....if you know anything about this please respond

    Default Mistake on Court Date

    What a mistake on the court date would do is give you an explanation for the court as to why you did not appear - but if you don't appear when the court thinks you should be there, it is likely that the court will issue a bench warrant for your arrest. If you get picked up on a bench warrant in the evening or on a weekend, you can actually spend time in jail before you get to see the judge to explain yourself. So.... my suggestion would be to call the court and get the correct date.

    An error on your friend's ticket won't provide you with a defense. In terms of your friend coming to your trial and testifying that the drugs and paraphernalia were his (and, ideally, that you didn't know about them), assuming the testimony is believed that could help.
