    Default Switching Custody To An Older Brother

    My twin sister and I (15) are in a bit of a pickle. We are not getting along with our mother. We have already talked about switching custody over to my adult brother(24). My mother said she is fine and willing to switch custody. The thing is he's moving to Arizona and we live in Florida. My sister and I can not legally live with our father because he is disabled and has a brain injury. My question is, Can we switch custody and if so how? I don't know if we have to look into the laws of both states or not. All help is greatly appreciated!

    Your brother needs to check with the school district where he will be living to see what it would take to enroll you in school. Will a power of attorney do the trick, or does he need a legal guardianship? If he nees a guardianship through a court, your father will be entitled to notice of the proceeding and (if he wishes) to object. Even for a grant of power of attorney, your father's consent may be necessary.
