    Post Non-Custodial Parent Moving Out Of State, Wants Change of Custody

    I Am German And I Have A Child With American. The Child Is 4 Years Old.

    I Have Physical Custody And We Have 50 /50 Legal Custody But With Mother Has The Last Word. My Child Live With Me And Go To Visit His Dad Two Night A Week. I Think Dad Has 25% Physical Custody Or Maybe Less Than That.

    In August, My Child's Dad Sent Me An Email Stated That He Was Moving Out Of The State Of California To The East Coast, He Basically Asked To Change His Visitation. He Wants November To December , March Visit And Summer From June To August. He Also Stated That If I Don't Give What He Requested, The Court Will Give Him More Time. He Is Not Trying To Talk He Is Just Telling That The Visitation Stated A Above Is What He Wants And Nothing Else Or We Will Take Me To Court.

    The Last Day Of August, I Got Served. He Filled With The State Of California For Sole Custody Based Of The Fact That He Is A Us Citizen, Maried And Have More Money Than Me. He Stated That He Can Provide More For Our Child Because I Am A Full Time Student Who Is Working Part Time.

    He Also Brougt Up The Fact That I Am Not A Us Citizen On It. He Does Not Know How I Am In The Us, If I Am Legal Or Not, If I Can Work Here Or Not, And Also Adding That I Do Not Speak English. He Also Mentioned That The Fact That I Speak German To Our Son, He Is Scared That Our Child Will Be Having Problem With The English Language And Be Behind In School Because Of German And The German Culture. He Does Not Feel Like Our Child Is Exposed Enough To The American Culture.

    The Hearing Is Next Week And Dad Is Moving The Folowing Week.

    I Am Willing To Give Me Alternate Vacation Times For Thanksgiving, Spring Break And Christmas And For Summer, It Will Need To Be Share Between Parents.


    Please Let Me Know What You Think About The Situation? What Are His Chances To Win What He Has Requested?
    Am I Being Reasonable With The Visitation?

    Please Help. I Want To Know What Will Be The Best Move To Do.

    Best move would be to get a good lawyer. Or, if you think he's right, give him full custody.
