I am in CA and I am the CP. Per the court order custody agreement, the NCP has the child about 30% of the time. In reality, for the past year and a half, the NCP has had the child less than 1% of the time.
I have a court date next month to modify visitation/custody/support. I expect everything I have asked for to be contested and that this may drag on for a long while. Assuming the parents have not yet reached a new visitation agreement through mediation, I will still be asking the court to modify support because both parents have had drastic financial changes since the original order back in 2000.
My specific question is this:
Will the judge make the new calculations based on the existing visitation order (70/30)? or on the actual visitation of the NCP (less than 1%)?
