    Default Subrogation Claim Against an Uninsured, At-Fault Driver

    I was involved in an accident that was my fault. My insurance had expired. I was not given a ticket at the scene but received it later in the mail.
    The other driver's insurance company had sent me a letter of sugrogation for a large amount($20,000). I am financially unable to pay that amount. I called the subrogating agency & tried to come to a settlement but the person I spoke to refused to listen to me & said that I will be receiving summons from court if I fail to pay the full amount.
    What should I do?

    Yep - you're responsible for the amt. the other driver's ins. co. paid out. They can sue & get a judgment against you if you don't pay the amt. owed. If you don't pay the judgment, they can seize assets that are non-exempt in your state. (You didn't give us the name of your state.)

    You probably will also lose you lic. for not having ins.

    Depending on state law, you may not be able to reinstate your license until any judgment they receive is paid. I do not know how this is affected by bankruptcy.
