Default Effect of DNA Testing on Establishment of Paternity
This is in Louisiana

If a DNA paternity test is done and confirms that ex-partner is the biological father, must his name be entered on the birth certificate?

Also, if once this paternity test proves the ex-partner is the father and the mother chooses to marry someone else prior to the baby being born, can the new husband be listed as the father on the birth certificate instead of the biological father?

Once a DNA test establishes a father, the father has the right to file to amend the BC.

DNA/paternity tests are rarely done before a child's birth. It presents a danger to the fetus, so it isn't done unless there is a dire medical reason to do so.

If a mother lists her husband as the father, already knowing that he is NOT the bio father, it is a crime. It's called fraud and can carry an extremely stiff penalty, including the possibilty of the bio father being given custody of HIS child.
