    Question What is a Fair Amount?

    State of Michigan

    In 2004 I had sold my mobile home to a family for $9500.00. They did not have all of the money and could not be financed. They were expecting an inheritance check with in a few weeks and were planning on paying for the home that way. We signed an agreement that I would accept $1,900.00 down and the balance in 60 days ($7600.00) When they received their check - it was not what the expected and only had $6,000.00. I accepted that with an agreement that the balance of $1,600.00 would be paid by March 1st of 2005. (tax return money) March 1st came and went. I attempted to call - number had been changed. I went to the home and the mother sent her teenage daughter to the door. I ended up serving them with a Notice to Quit. This drug out - they ended up contacting me saying that they didn't have the money from the tax return. I was trying to be reasonable and was depending on that money to go to VA to pick up fiance who was returning from his duty in Iraq. I didn't want to disappoint him by not being there when he came off of the plane.... I ended up having to borrow the money from my parents. They called while I was on my to VA - I did something really stupid at this point. I gave her my checking account number to have her deposit the money in my account. After being gone for a week and returning home - the money she deposited was not the full amount. They still owed $850.00. I tried to contact them - just to find out that they had gone to Florida on vacation!!! I ended up serving them a second time with a Notice to Quit Tenancy.......also had my bank (attempt) to put a notice on my account that no one other than myself to be able to deposit into my account. Within 2 weeks - they managed to deposit the balance - to avoid the eviction BUT NEVER contacted me to tell me that they had done this. This last year, I was even in the same hospital waiting area as them and they saw me and turned their backs and did not bother to approach me. Now within the past few months - they have attempted to contact me - they have left my personal information on answering machines with my name, bank name, and account number! They even called my old employment leaving nasty messages because I still have the title to the home. From the time that they had moved into the park where the trailer is located until the beginning of last year - I would receive notices that they were behind in lot rent and water bills and that since I still owned the home that I would be financially responsible.
    Now I am being asked for an amount of compensation for the "trouble" they have caused me in the past 3 years....... They have suggested $100.00.

    What is fair and what is reasonable?

    If they get a lawyer, they may find out that they have a case against you for bringing eviction actions against them even though they were buying the home and were not your tenants. Also if they are paid in full and you're refusing to give them title, you don't appear to have any right to do so. Is it safe to assume at this point that you never had a written contract governing this sale?

    The only written contract that we had stated that the home was to be paid off in full by 60 days of the signing. The 2 Notice's to Quit Tenancy was suggested by the mobile home park's attorney because they did not own the home and they were not paying their lot rent each month. I had sought out the help of the park because I didn't know what to do when I started to receive notification that I was to pay their lot rent.
    They do have an attorney - he is the one that sent me notice today that they are willing to compensate me $100.00 for my trouble IF I feel that this is a fair amount. This attorney contacted me about the title - and couldn't understand to why I had not just sent them the title. After speaking with the attorney and explaining to him and supplying him with documents etc... that they did not contact me after making the last payment nor did they inform me that they were making the payment. It is not until now - 2 years later are they contacting me because they would like to sell the home. The attorney went back to them discussed with them what was discussed between us and he stated that he was unaware that there had been issued during the "sale" and the "payment period" of the home. That is when I receive this notice of the "compensation".
    I am not refusing to give them the title - I have no problems in doing so. And this does sound petty as hell - but they screwed around in paying me, creating unnecessary aggravation and trips to Michigan etc....my having to consult an attorney (then) about eviction and the possiblility of my paying their late lot rent etc..... I am just doing the same by not being fully cooperative in giving them the title. BUT I would never take their personal banking info and leave it on answering machines or discuss it with their employers! I had to close accounts and reopen another - because of fear of identity theft. Then I had to reroute automatic deposits and payments from that account.

    I just have to give this attorney an answer - -

    You have to decide for yourself if it is sufficient. If you don't believe so, try to negotiate for more.
