Default New Problems with Neck Injury after Release by Comp Doctor
Hi -
Thanks for taking the time to read this. I am pretty sure I need to contact an attorney, but before I do this, I am wondering what to expect. In short, I had a work related injury, WC paid my wages while off work, paid for medical treatment, surgery, PT, etc. All was fine. Injury occured in November 2004, my neck surgery was in January 2005, it is now August 2005 and I have reoccuring problems/pain. I contacted my neurosurgeon who scheduled an MRI and meds for pain. Upon picking up my Rx, I learned that my case had been closed. When I questioned the adjuster at the WC insurance company, she stated that because the IME determined in April that I was 100% healed, my case was closed and that all expenses now would be my responsibility. I went for the MRI, it was determined that I have scar tissue which is causing pressure on the disks operated on putting pressure on my spinal cord. This is DIRECTLY related to the initial injury. My surgeon tells me that I can work as long as I can tolerate the discomfort, but will eventually (soon) require surgery again. Can you please tell me what I may expect? What can I do? I cannot afford these medical bills, I am still behind on my house payment, car payment, etc from being out of work for 7 months during the surgery, etc. I cannot afford to be out of work again...I will lose my home. Please advise...

Default Cut off from workers' compensation, but need medical care
I hate to fulfill your expectation, but... if the workers' compensation carrier won't promptly re-open your case on the basis of the new medical information and voluntarily resume payment, I really think you should consult a workers' compensation lawyer in your state.

Thank you so much!! I did contact an attorney here in Michigan (upon your advice). I was advised to try to "play nice" with the insurance company by submitting the updated medical records. If they don't want to play nice, I guess things will have to get "oinky", but hopefully we won't have to go there. I'm not looking for a settlement, just for them to take care of the related expenses. Again, thank you.
