    Default Will The Court Issue a Warrant Following Unemployment and Inability to Pay Support

    Got a question. Yes another hypothetical Florida question.

    Tomorrow I go to CS trial and have no idea what they are gonna make me pay every month. I have been without a job for a while now, believe me, not by choice. NO ONE WANTS TO HIRE ME. Plus, I have absolutely zero money. Now I am terrified, if I don't find some sort of job asap, they will take my license away, and then issue a warrant. Arreages will pile up, hopefully not, and if I do find a job and then start paying, how do I have the warrant stopped w/o getting arrested.

    I wish I had a car and some money, so I could get some legal aid, but here in Jax FL, everything is sooooo far and no buses or public transportation where I live, boonies. I don't even have decent clothes. Why doesn't the courst understand situations like these. Oh yeah, cuz I am a man.

    How did your hearing turn out?

    I didn't see this post until now, but you cannot be arrested unless there is already a court order. IF there is a temp order and you have not paid, or, if you do not appear in court for a hearing, the court can issue a bench warrant.

    I do have one question about your post though- if you are so broke, how is it that you are able to post anything on the internet? (I know of one possibilty, but I'll wait for your reply before bringing it up.)

    I went to trial, I don't know if this is a temp order or a court order? Never knew their being two types, how do I know? Well, I have been ordered to pay 265$ a month, and 35$/mn in rears, whichs amounts to (265x26)-900$ (checks I was able to find that I gave the B***h who said I never gave her a dime. I was soooo stupid not to keep a better record, and to give her cash a lot. Funny, as soon as I got home, I found several more checks, but they amounted to around 600$, so it's not biggie.

    So, I am just shy of 6K in rears, and looking at 300$/month. They said they will mail me the order, so I assume it court ordered? They told me to GFM when I asked for a DNA test, since I signed a birth cert.

    The Hemphill dude is a major panzy/prick! Judge was kinda cool (fat bastid though, I see where our tax dollars go) and was OK with a DNA test, but that jerk was like noooooo. It's sad how my ex somehow cries her frig'n way thru every thing she can. No biggie. I asked my mom. Do you think she looks like me, and if she thinks w/o a doubt that she is my child? Mom said 100%. So, I let it go. No DNA later...

    It's called using other peoples stuff.
    Anyone in Jacksonville, FL wanna hire me???
    I am much more than willing to work!
    UF graduate, with a BS in Micro-Bio.
    NO JOBS HERE for me.

    Apparently the court went back the full 2 years allowable for retroactive support. You are actually very fortunate that the Judge only ordered $35.00 a month for retro payments, it could have easily been much more.

    Until you recieve a copy of the order, you should just assume that it is a final order, rather than a temporary one. You should also begin making payments, even if you haven't recieved a copy of the order yet.

    Jax is a large city (in comparison to Sebring), so I'm sure that there is some job available somewhere, even if it's not the perfect job. Now that you have officially been ordered to pay, you really need to find any job you can and begin paying. IF you get behind, and make no effort at all, you will almost certainly land in jail and have to pay a large purge on top of that. Good luck and keep looking for that job.

    Is it true if I make payments, no matter how much less than ordered, they can't put a warrant, regardless what the order is for?

    I have 300$ a month of CS ordered payments.

    So, If I pay 100$ a month in the meantime, till I find something, I am safe from jail/warrant, right?

    If you cannot or don't want to pay the amount ordered by the court, you should seek relief from the order. Judges expect their orders to be followed.
