    Default Can You File Someone's Taxes Based On A Power of Attorney

    Just need to know if I can file my fiances taxes from 2006?? I am his power of attorney and he has been incarcerated since June of 2006 but was working up until he took his plea. I just dont want him to come home with yet another problem hanging over our heads. I have all the paperwork i need to file (i think). If i can do his taxes can I do like Turbo Tax or do I have to go to some place like H&R Block??? Thanks in advance for your help!!

    A: Yes, if a valid power of attorney gives you that power.

    I believe that i do. It states many things in the power of attorney paperwork of things that i can handle. It includes any and all financial situations having to do with him. I sent the IRS a copy of said paperwork as well as i letter asking to contact me and tell me how to go about filing his taxes...well let's see that was months ago.

    You don't need instructions from them, you just need to go ahead and file the tax return. I would recommend using a professional to assist you. They will make sure that the proper forms are included and that its signed properly.
