Unhappy Terminating an Incarcerated Father's Rights
Hi, I am a single mom in Nevada. My sons bio-father was arrested for murder when my son was only 10 months old, and has been incarserated for the last 6 years. I got divorced a few years ago, and there is a visitation order that states that the bio-dads family is responsible for all visitations with my son. In the last six years they have never set a time to pick up my son for visitation (much to my relief). I have been solely supporting my son since the arrest of my ex-husband without any assistance from the father at all.

3 years ago I had another child from someone else and he wants to adopt my oldest child. We have no intentions of getting married, but are very good friends. He has been the father figure for my oldest son for the last several years.

I really want to know what I can do and if I even have a chance of being able to terminate my ex-husbands parental rights, please help me!!

hi I am a single mother of 2 children. My oldest son is from a marriage that fell apart. My ex-husband was arrested and convicted of murder 6 years ago, in which time he has not had any visitations with my son. There is a vistiation order that says he is allowed 6 visits a year that the paternal grandmother is responsible for. She has never set up any times to pick up my son since his fathers arrest 6 years ago (much to my relief).

My ex husband is expected to be released after my son turn 13 years old. I have never recieved any child-support, nor will I recieve any until after his father maybe gets out of prison. I also do not need any from him.

My second child father has been the father figure for my oldest chil for several years and wants to adopt him, I know that my ex-husband will want to fight this, bnut I really feel that it is in my sons best interest not to have contact with a convicted murderer.

my youngest sons father and I have no intentions of getting married, we are not even together romantically anymore, so I really dont know what to do. I really could use some help.

I really, really doubt that a court will allow a TPR so that your EX boyfriend can adopt your child. If you were married to the guy...maybe...But it seem like the only reason you are wanting to do this is to take away the right of the father, because you fear him. You should consult with a Family Law attorney in your area to see if JUST a TPR is possible under these circumstances.

I'm not scared of my ex husband, and my youngest sons father has wanted to adopt the oldest since we were together, he is willing to take all parental rights and responsibilities for my oldest. my oldest even calls him dad. The man that My ex-husband killed was his best friend, he was drunk at the time of that incident, and more than likely high as well.

also He origionally was found guilty of second degree murder which was overturned, at which point he plead guilty to voluntary manslaughter, i dont know if this helps but I hope that it may give you more information about my situation.

ok si I got one response from someone thatnk you very much I really appreciate it. I have another question, I have set an appointment with a family lawyer, what I want to know is since the father was required to pay child support and has not been able to for obvious reasons, but still owes arears, will he still owe that to me after his rights are terminated??
