Default Paternity Testing and the Military
Ex is in the military. I'm in California. Baby is now a year and a half. He hid behind the military in regards to child support(the only way we could figure when the baby was born that he could get the baby into DEERS and onto Tri-Care, the military insurance). Needed the paternity test. Once filed for support, they decided he should pay over $900 a month for support--child support officer had verbal agreement since he was getting deployed that he'd go into the office to be served. Upon finding out amount--he balked, never showed. Had to track him down through the military to get him served. Finally got him served while he's out in Iraq(been there a year, out there til June next year) He's National Guard/Army--if that helps. He requested a Paternity test in his response. Working with his superiors AND my ex, Child Support Office arranged for the test to take place this past week while he is in the area on leave(he had two weeks, none of which was spent with son, his choice). He decides last minute NOT to take test, saying it's not *court-ordered* (even though he REQUESTED one in his response?) and that Child Support cannot MAKE him take a paternity test citing the Soldier and Sailors Civil Relief Act. Is he actually COVERED under that? Is he STILL using the military to hide behind??? If so, is there ANYTHING I can do to try to get him to at least have to provide the medical for his son? This baby was NOT a *surprise*, just unwanted once he decided he was done using me to make his ex jealous apparently and went back to her. They aren't together anymore either and baby is still ignored by father.
Any info or advise on where to go would be great!

Has he formally asserted his rights under the SSCRA, or is that just an excuse he made to you for refusing to take the test? Have you tried contacting his commanding officer? (They love that (sarcasm), but they can't do anything to the civilian who is contacting them, so....)
