Default ATV Reposession Indiana
A buddy and I went together and got some ATV's on a buddy pack deal. I am listed as the primary and he is the secondary. He has 2 atv's and I have 1. He has chose not to pay for them now. Can I legally reposess them from him? In another word, take them so I can resale them and apply it to the account? I am having to pay for all of them at this time to keep my credit good. Can someone please help me.

You mean on ownership documents or title work, or on the loans? The question for taking possession of the ATV's is whether you have an ownership interest or security interest.

The account is in both our names. I am the primary card holder and he is the secondary card holder. They are in both our names.

If you have no ownership interest in the ATV's, and no formal lien, you can't "repossess" them. You can ask him to turn them over to you and, failing that, sue him in small claims court.
