    Question.. If my friend goes to the interview alone.. Before it starts can he ask the investagator "Before we start, Am I being considered a suspect in this case?" and if the officer states yes then tell the officer "In that case I would feel more comfortable consulting with a lawyer before I do a interview with you" If he says no that your not a suspect.. Can he say "Am I currently being charged with any crimes" What im getting at is does the officer have to answer theses questions honestly and btw I think my friend is aloud to bring in a tape recorder or video camera to tape everything that happends.. Is this correct? I know that he has to tell the officer that he is recording.. I am sorry everyone if I seem hostle its just that I HATE police and i know 95% of them are croupt and will get anyone they can to pin the crime to.. I have experienced this personally and know how they like to scare the living shit out of you. And as for all the advice i have gotten from panther and aron so far has been that they will charge him no matter what even without evdense.. Am I wrong to assume that the burden of proof is on the police not my friend?? panther is making it seem that my friend has to prove hes inncocent.. but how do u prove ur inoccent if you where not there and have nothing to do with this crime.. Only thing he can prove is that he was with other people while this crime happened. (forgive the spelling)

    He's a suspect. If he hasn't figured that out by now, there's no helping him.

    I can't stress this enough, get him to the police station, even if he has to walk there.
    Believe me they are not just sitting around waiting for him.
    They are investigating, so that when they do talk to him they have information. They are checking phone records, and witnesses that may have seen them together. They are taking statements. If he is innocent why not just go and give them the names of the people he was with. How in the world is there a time associated with the "dirty deed".
    He just better hope there is nothing incriminating on myspace. I simply can't believe that her mother just picked his name off of her myspace to blame. Think how would she know what his voice sounds like. Are you sure you are getting the whole story?

    Your friend can ASK anything he wants. The officer is free to lie, or to obfuscate the matter. Perhaps asking, "Why? Should you be a suspect?"

    Generally, no. So long as the officer's actions and words would not induce an innocent person to confess to something he did not do, he can generally lie. Depending on the nature of the lie, it might have an effect in court later on, but they CAN lie to the defendant.

    Uh ... generally, no. But, since everything is voluntary, your friend could always say he's not talking if he can't record the interview.

    The burden of proof is on "the state". That is, the DA will have to make its case beyond a reasonable doubt.

    You keep saying your friend does not even know the girl, yet how is it that the girl's mother would suspect some guy that she does not even know as the guy in the video?

    You also do not know what the girl has told the police. Perhaps she dimed him off?

    Bottom line: Your pal needs an attorney. if he cannot afford one, perhaps he should just wait for the cops to come to him. If they build a case, they will come to arrest him. If they cannot, then he will be free to continue whatever life he has without transportation and means.
