    Default Relocation to Indiana

    Hi,
    I have just been offered a transfer in my company with greater income and job oportunity. I currently live in West Tn and am going to be transfering to South East Indiana. My job will be about a half hour away in Cincinnati Ohio. I have a son that is almost 5. I never married his father and we separated in Nov. of this past year. We have a house together and are still trying to peacefully excist together in that same house until it sells. We have not had any court procedings determining who is primary parent. When we were a couple I did 90 % of the taking care of our son. Now that we have split since this May he has been doing about 40% of taking care of him to look good for the courts. He has had 3 prior DWI and has a drinking problem. The DWI were back in 2001 right before we moved to TN. He was verbally abusive to me and my son. He has since May stoped drinking in front of me but I know he is now drinking and driving with him. We work a rotating shift now and my new job would be a straight day job. Much better for my son. His father is wanting joint custody and me to stay here. I do not want to stay because the move would also mean me being closer to both mine and his family. Everyone but 1 of my son's father's relatives live in Northern Indiana. I want to know if I will be able to move with my son to the other state?

    You either have to get permission from your son's father or from a Judge.
    The DWI's are irrelevant ...they happened in '01 BEFORE your child was born.

    Hi, I know they might not use his DWI in court but he is still drinking and driving. I used to do all of the driving and errands when we were together or he probably would have one now. He has also given up rites to his daughter and hasn't seen or talked to her in about 16 yrs. He did this in order not to pay child support. He said to me the only reason he wants joint custody and me not to move is so he doesn't have to pay child support on our son. He will fight me moving. Even if they don't use his past DWI's and daughter against him(I think it should play a factor since it shows past history), will I be likely to move out of the state with my son?
