I work at a juvenile treatment center. From 2004 to 2006, I was having problems with a supervisor. He was not properly doing his job. I had administrators of the facility ask me about many situations and when i told what was going on he would retaliate. A co-worker was also having problems. He was calling in days at a time. He thought he was going to get written up or lose his job before his probation was up. He begged for my daughter to babysit for him because he needed to get his car fixed in order to have transportation. I allowed her to babysit and she called me several times telling me how horrible the oldest daughter was being to her and her siblings. She was making the baby fall over and cry and she was calling everyone names and trying to get my daughter to give her a bath. She asked me to tell him to hurry home. I called him several time and recieved no answer. Another co-worker of mine was trying to call him also and I stayed on the phone with my daughter until he finally arrived. He was late in getting home and returned her home late. I told her she would never babysit for them again.
Five months later we recieve court papers. She was being charged for criminal sexual conduct in the first degree. The trial was delayed several times because my coworker and family moved and refused to cooperate with our attorney. We had no number or address. My co-worker came to me and asked me if anyone had talked to my daughter. He explained that his daughter said something about boobies and his wife reported it. He went on to say nothing will come out of this because she tells a lot of far fetched stories.
Meanwhile I was still having problems at work. My supervisor knew before I knew that we were going to be served court papers for this. He was giving my co-worker rewards of gift cards almost weekly for "employee of the week" (which is against county policy) They were all of a sudden best buddies. As it turned out the supervisors knew and so did our Managerial Operator who ran the facility. The rumors started out with "My co-workers family was going to sue me and my family." and We were having problems working together" Problems I didn't know about. We had a meeting to determine how everyone knew my daughter was going to be charged before i did. The responses I recieved was I cannot say. I pushed the issue of who told this to the managerial operator and he continued to say he couldn't tell me who told him this information. I pushed the issue of exactly what was said. He Yelled accross the table "I was told that your daughter sexually offended xxxx's daughter!!! I was in tears and ran out of the meeting. The association representative delayed writing a grievance on my behalf. There was a mediation meeting and he basically said I should apologize to him.
The trial interrupted my daughter's entire life. Everytime she was looked over for a job, she was worried. She could not concentrate on volleyball and missed some practices. She lost her starting position on the team her senior year. No one will ever say that's why you didn't get hired or that's whay you are not playing but you have to wonder.
The case was taken to trial and lasted 2 days. During the trial the stories had changed several times. The parents both told three different stories each. Thes story now also included that my daughter had also sexually abused the second daughter also. Neither child could identify who my daughter was. The assistant district attorney had to ask for a recess because she was getting angry. She asked for me to be removed from court because she had me on her witness list. During the recess the woman from victim services had to describe to the little girl what my daughter was wearing so she could identify her. Both sisters have some type of speech impediment and learning disorder. They were not able to identify truth from a lie.
The detective admitted this was the first time he had ever used the cornerhouse investigation process which I found out is suppose to be done with two people. He pulled my daughter out of school to question at age 16. He never contacted us. He was slow in returning my calls. He said he didn't get around to it. He admitted that he pushed and question my daugter more than he should have because he was told "there had been a crime committed here" by the assistant district attorney.
My employment is with the county and I know how people's business get around even when its not suppose to. Victim services is also part of the county. I also found out that the mother(coworker's wife) went to victim services to apply for a job the same time this was reported. This is a small town.
While i was on the stand it was humiliating to see people i have been to trainings and many other county events. The court reporter was giving me nods and smiles of approval because I had a well kept calendar with all the dates and times of my children's activities....even when my daughter babysat. I also had cell phone records of the day she babysat. I had recorded when her braces were taken off and pictures of how she looked then. Also, I knew how many other babysitters they had because no one wanted to sit for them anymore. My co-worker and his wife did not know dates and claimed they remembered because she had her braces on. It was suspected that my co-worker was out cheating and drinking and did not want this revealed. He often left his kids with his wife's long lost homeless brother without her knowledge. On top of that we work with children...we are mandated reporters. He claimed his daughter told him this and he reported it four months later not within the 24hrs as we were trained. The case was dismissed.
I didn't include that i am one of the association(like a union) contacts at my job. Another co-worker who was also a contact was given a poor reference when she applied for the police department even though she had the highest score they ever had.She was continually harassed.
The assistant district attorney called my job and told them she felt i was uncomfortable escorting kids to court because of our "history". This was 5 months later.
Do i have any kind of case at all. This county is known for a lot of wrong doing but no one has been successful in suing so they continue their dirt. Lawyers here say "I have to continue to work here". Others want high fees to continue the process. Do I have a case in any area?
Even though the case was dismissed it's listed at the courthouse. my daughter is afraid to leave home for fear this will hinder her from doing anything she wants to do. We will have to pay over $500 to have an expungement done. I believe they thought I would quit my job. I have seniority over all my co-worker's. My supervisor called me while I was on a workman's comp day and told me I had to work weekends. My co-worker was promised weekends off. I do believe they wanted me out of the way. I am in the state of Minnesota.
