    Default My Daughters Taken From Me

    I am an American living in the Philippines and I had twin Daughters by a Philippine women in 2001. We never married, but she married a Mexican American and took the children out of the country without my permission to California on a K4 visa attached to her K3 marriage visa last March 2006.

    At the time my name was not on the childrens brith certificates. Now however, my name is entered on the childrens birth certificates as the Father. I had it ammended after she took my kids. I managed to get a custody order from the Philippiine court granting me sole temporary custody. Can anyone tell me what the position of the State Dept. or the Claifornia court would be on this. I want the children returned to me in the Philippines. The Mother is not a U S Citizen yet or are the kids.

    You can attempt to enforce the Philippines order through the California courts. If the court finds that due process was observed, it will likely enforce the order. Consult a family lawyer in the county where the children are presently located, about the process of regaining custody.

    Hello Again,

    I was told by the State Dept. To have the Mother cited for contempt of court by the Philippine court and have that sent to Interpol via the Philippine Police {they agreed to do so} and that will be sent to California police. I was told that would be the fastest way to force her to bring my kids back, as it will be abduction. Her husband, will he be liable also since he signed a petition to bring my kids to the U S and support them? Could he not withdraw his support and by not doing so will show him also to be in accomplice with the Mother?

    Also, the Mother is due for her permanent residency in several months. Will a criminal contempt charge {and perhaps abduction} in her native country possibly disqualify her for permanent residency and future citizenship in the U S.? One would think so...

    I am also in the process of having my children’s Philippine passports voided and a certified letter from the appropriate Philippine office stating as such.
