Default After Voluntary Repo of Truck, Bank States That Dealer Cosigned, in Pennsylvania
I live in PA and I have no choice but to return my truck.The dealer got me easily financed through a regular bank(poor credit) without a co signer. ( So i thought) . Anyways I called the bank today and told them this and they called me back ,and told me where to drop it off then said it would be going to the original dealer. That he gauranteed the loan.

I was confused because he never told me this. I feel bad but what options does he have to come after me? He rolled over neg equity when I bought it from another loan so I probably owe 6K more then what its worth. I guess he would put it back on his lot and pay the bank off because I assume he is the cosigner. Again I live in PA and I am not sure on the collection laws.

Is there anything he can do to sue me and win a judgement where he could garnish my wages?

Look at your contract with the dealer. I expect that it permits them to pursue you for a deficiency following default. If not, they may still have an equitable claim against you.

I never received a contract at all. He never even told me he cosigned. I went to him numorous times right after I bought it to retrieve my pink slip for it. I will just wait and see what happens. I returned the truck today.
