    Default Certified Copy of Conviction

    I am attempting to handle my legal issues on my own. It is my understanding that for an expungement that I should obtain a certified copy of conviction, or sentance from the Monroe County Clerk of Court. My case was for Felony embezzlement in which I was charged in November of 2001. I went to the M.C. Clerk of Court today and asked for this document and they told me they had no idea what I was talking about and gave me what I believe was a "dockette" Which included all legal documents involved in the case. The clerk further explained that I could not leave the counter with it and that any copies are $1 each. The problem I have is now what should I do in order to obtain a certified copy of sentence, or conviction in order to continue on with the process?

    There should be a "disposition sheet" in your file, which is presumably what you want. If so, you would purchase a certified copy of that document from the Clerk of the Court. As you note there is a $1 copying fee, and I expect that there would be an additional fee for certification.

    Is the 5 year wait as of date of sentence or of release from probation?

    The statute provides, "An application shall not be filed until at least 5 years following imposition of the sentence for the conviction that the applicant seeks to set aside or 5 years following completion of any term of imprisonment for that conviction, whichever occurs later".

    Would "any term of imprisonment" include probation? and therefor would be dependant on the release date from probation.

    Probation is not imprisonment. Jail, prison, or a half-way house are imprisonment. House arrest may count as imprisonment, although I haven't researched the issue.

    Would an OWVI count as a misdeameanor and disqualify me from expungement.

    OWI is a criminal misdemeanor. See MCL 257.625.
