    Default Marriage To An Ex-Felon While On Probation

    I am a convicted felon on probation.
    My charge was Theft.
    I want to marry another convicted felon
    He served his time and is not on parole or probation
    We both work and walk the straight and narrow.
    First time offence for both of us.
    His charge was drug related.

    Now, my question is
    Are we allowed to get married?
    he is in poor health and I barely make it finacially
    He has a great income from working and retirement pension.
    He loves me and does not judge me as most shall I say 'Good men" do
    Ya know the kind that have never made a mistake.
    he wants to make sure that if something happens to him, that I recieve his retirement and I am finacially secure. This is real love on both our parts.
    It is hard to find someone that will still love you and care after you have broken the law, been down on your luck and did something stupid like I did.
    I pay restitution monthly and I never fail to go see my PO who is a beautiful , kind person. I actually like her. She treats me like a human.

    I have been reading these threads and this is a great site, very interesting.
    I have been told that I am NOT to associate with known felons, but, I have been also told that this means basically to conspire to commit other crimes which, we are not planning on ever doing...we both learned our lessons the hard way.
    I am going to marry this man one way or the other.
    I may have to just keep it secret.
    Please can anyone here give me an a reliable answer

    If a condition of your probation is to not associate with any known felons, that means you can't go out with, be friends with, or live with a known felon. Period. If you choose to violate your probation despite that, be prepared to be arrested and imprisoned for the rest of your sentence along with any additional time you get for the violation.

    What if I ask to do this, do they ever grant permission
    I think sometimes I may as well have gone to prison.
    I commited a non violent stupid crime and I am paying dearly for it
    More than I should!
    Seems they can just control your entire life.
    This is damn well not fair.
    I think I will just secretly do it!
    I find it hard to believe that they don't make an exception.
    My brother is a convicted felon from 25 years ago. Drunk driving accident.
    Now, does that mean I can not associate or visit with my brother either.
    I would like to ask for some more comments on this please.

    Not that I don't appreciate the first reply but, it sounded a bit harsh! and so final.
    I find it hard to believe that they can tell you who to fall in love with.
    He is free of jail and probation and mine is a deal with pay off the restitution and then I am free from probation also.
    I pay every month to probation and to resttitution for a crime that I commited and yes, I have remorse and know I did wrong
    I will say however that I had a public defender that was not too good. I pleaded guilty to a certain amount and the so called victim accused me of a much higher amount so, somehow when I pleaded gulity, it was to that higher amount and my defender did not even argue my case.
    I had never been in trouble in my life and had no clue what I was doing or what he was doing, I trusted that defender to help me.
    He had a heavy case load I guess because he treated my case like an assembly line and now it is too late for me to do anything about it.

    Is this true that I may not be able to marry my fiance?
    We are both close to 50 and I need this financial security because between restitution and probation fines, I am always broke.
    I pay it though. I try and do the right thing now.
    I wish he had never told me that he was a felon, then I could have married him and never had this worry
    These rules are not fair.
    Take my money and visit my home but, tellinhg me who to love and all that is a bit ridiculous
    They never visit me and I am even supposed to be on unsupervised probation in the state where this happened. My case was transferred to another state at my request.
    How can one state have you on unsupervised and another make it supervised.
    Be so much easier if all states had the same laws.

    I wasn't being harsh, I was being blunt. My warm and fuzzy font isn't working today...lol!!
    You have said repeatedly that you were going to marry this guy no matter what... So I was just telling you what could happen to you if you are caught violating your probation.
    Probation is a chance to serve out your "time" at home as opposed to prison. It is strict and they expect you to follow their rules exactly.

    Ask your PO if you can marry this guy...who knows she might say yes.

    Has your denial been put in writing after a request in writing??

    Conditions of probation are defined by statute and the case law.

    You can consult an att to see IF the case law is quite specific in this area or not, that is, is the constitutional law clearly established a felon may not marry a felon without violating a condition of probation.

    Marriage is a fundamental right, per the USSC, BUT a person on probation is not entitled to certain rights as the average citizenry.

    You need to consult an att. IF the law in unclear in that area for your state, ask him or her what can be challenged in court.

    Just I feel that my whole world is falling apart and it is just not fair
    I got railroaded over a $5000 theft, it turned into a lot more and I had bad representation.
    Sometimes I wish I had gone to prison so that I would not have to be out here in the real world where I can continue to be punished over and over again
    Ya know, it feels that way.
    I wish I would win the lottery and pay this off and really be free.
    Dosen't hurt to dream I guess.
