Default Putative Father vs Biological Father
Question: If the putative father, and husband, knows who the biological father is, what are his chances in suing the biological father to force him to take responsibility for the child as well as pay for costs that the putative father incurred while raising the child? The state is Virginia.

How old is the child? When and how did you find out that you were not the biological father of this child? Did the bio-father KNOW he had a child?

No one replied so I will ask basically the same question for the same state, VA

Wife has affair, became pregnant
denies affair, and all possibility that child could be anyone but husband.
Child born and raised till age 3 by husband and wife.
prior to child's 3rd birthday, wife has another affair, gets caught and emails reveal wife admits to previous affair to new paramour.
wife finally admits possibility of first affair being cause of pregnancy.
DNA ( non- legally binding) reveals that husband is 100% excluded from paternity. husband will seek divorce on grounds.
wife then submits to Dept. of Child Support Enforcement name of guy from affair #1 as father. Apparently he has not been located yet.

Since wife has named first affair as father to state, how may that affect the states presumption of husband being father?

Wife claims once bio father found, he will be charged with support and not be permitted to see child. (not sure how that is supposed to work).

I do have a consult with divorce Atty. next week and have been researching what in the world I can/should/should not do in the mean time.

If wife charges biodad with paternity, does that begin the process of dis-establishing me?

This whole situation is having a terrible toll on me emotionally. We also have our first child so this divorce is going to be a little hard on him too.
