In March of 2005 I was convicted on a single count of possession of Fentanyl, a controlled substance. It was a misdemeanor conviction and I had no priors. I was sentenced to 30 months probation which is will end next month. According to my public defender, there was no chance of pre-trial diversion and I was fortunate that it was not deemed a felony charge. This was in part due to the fact that I self-reported, sent myself to treatment, cooperated with the investigators, plead guilty and have behaved according to the probationary guidelines since my conviction.
I called my public defender this week to ask him about having my record expunged and he was unable to give me a definitive answer. He stated that he lacked the knowledge of the procedure and/or possibility for expungement in this instance.
So my question is this, is it possible to have my record expunged and if so how does that take place
Thanks.![]()
