Back in January I was arrested for a DUI in Maryland after a hit and run accident totaled my car (I was hit, the other driver ran). The police that were called to the scene did a breathalyzer and a field sobriety test and found I was a 0.16 BAC. The thing is, I live in Pennsylvania. Also, I had a DUI (which was a 0.08) in PA back in 2004, for which I completed an alcohol safe driving course, there was no license suspension, and I had a year's worth of probation. That offense was supposed to be expunged, although I was told if I were ever to get another DUI it would come back onto my record. My trial in MD is coming up in a couple weeks and I really don't know how things are going to work because PA and MD have reciprocity - but not the same laws. So far no one seems to really know what to tell me, even my lawyer...I just have to wait and see.
So can anyone here tell me how this reciprocity between states (MD and PA specifically) works? For example, if I don't get sentenced to jailtime by the judge in Baltimore can PA turn around and give me jailtime anyway? I can deal with license suspension and fines, but going to jail seriously scares me to death.
