Default Establishing Paternity of Adult Child in Louisiana
Hi,
My name is Tammie. I had a DNA test done on 08/01/84. The test showed: combined paternity index 169 to 1, probability of paternity 99.41%, and we share common genetic markers. I am now 30 years old and want his name on my birth certificate. My mom went to court when I was 16 for child support, but it was denied. My dad's wife's father was a judge and my mom thinks that played into it. He also claimed his brother was my father, but my mom says "NO WAY AT ALL". My question is can I force him to do another DNA test (or will the one from 1984 work) and add his name to my birth certificate?

The Louisiana Civil Code, Sec. 197, provides for a child to bring an action to establish paternity. I do not see any statutes which would clarify if that means "only a minor child" or if it would extend to an adult child, nor do I see anything which would dictate a time limit. I suggest consulting a family lawyer about the statute, and whether or not you can still pursue a paternity case under Louisiana law.
