Default Claims of Paternity After a One Night Stand
My fiance had a one night stand with a women who was separated from her husband but not legally separated. She is now claiming she was divorced at the time which we are still looking into. My question is if she was in fact still married and she's coming after my fiance for child support and what not wouldn't they consider her husband the legal father. The child is already 6 months old and my fiance is NOT on the birth certificate. Also the child resides in Tennesse but the state is asking for California's aid in getting this solved so we have court out here...Please help with any information!!!

In addition to the other response, your fiance should insist on a COURT ORDERED DNA test.

Is her husband on the birth certificate? If they were divorced and he was not held responsible for the child, then your fiance should expect being served with a paternity suit. Even if they are only now getting divorced, if the husband contests paternity, I believe he may bring suit against your fiance to relieve himself of being responsible for supporting your fiance's child. I am not an attorney, however.

Why do you think this woman's husband or ex-husband should pay to raise your fiance's child? You know, it only takes "one night" to make a baby.
