    Default Rock from Dump Truck Cracked my Windshield

    I got trucking company name, and truck number. (No tag, as georgia allows dump trucks to have tag placed on front of vehicle only).

    Recorded time, place, and other info.

    Cop is telling me that he cannot file a report since the damage is less than $500.

    What course of action should I take?

    Proving that the rock came from the dump truck (instead of, say, the roadway) is impossible.

    However, if you want to sue in small claims and try, go ahead.

    Well, proof would be hard, yes, but I actually saw the rock come from the truck itself. I have no witnesses, but I would be willing to testify in court under oath that the rock came from the truck. Of course, a person's word means little anymore, sadly.

    Thanks for the answer, it would almost be worth it to go to court just to plead my case, even if I lost. This will be the 7th crack I have received from a truck in a year, it is getting ridiculous. The last 6 were on my old beat up truck, this however, is on my brand new car, so I am a little more upset about it.

    Have you tried contacting the trucking company with your claim? Something similar happened to me about 2 years ago; I contacted the company, they wrote a letter of apology and asked for the bill to fix the headlight - I sent the bill, they sent me a check for the $35.00.

    I work for a trucking company. I have never delt with claims but I have herd things from people who have. You need to call the trucking company, explain the situation to them. Most of the time they are going to try different tacticts to make it look like your fault. Just give them a story and stick to it. They will give you a maximum of $500 dollars they always try to start out with less but you can usually get up to $500 for it. They dont ask for quotes or anything like that for most companys. When something like that happens there is a number on every truck. Not a plate but a number on the side or the back usually about 4 or 5 digits long. You should always get that number off of the truck. Since you dont have that number try contacting the trucking company and getting your window repaired that way.
