    Default Deportation, Marriage, and Re-Entry Into Canada

    Hi all, this is my problem. I am a Canadian citizen and my Fiancee and her family (Her mother and brother) have recently been deported. They came to the US around 6/7 years ago, her mum then came to Canada with my fiancee and her brother. They did not know anyone and had little to no money and were given bad legal advice. They applied for Refugee and were denied then they were told to apply for pre removal risk assessment (PRAA) and were rejected before that. However, Around close to 2 years before they were even told anything about deportation, her mum met a guy and they got engaged and lived together for close to a year ( they knew each other longer of course), they did not get married due to the fact that her mother did not get divorced from a previous marriage so they had to do all th epaperwork with her real father by mail. After all was said and done, they FINALLY got married but this was about 3 days after receiving a deportation order. So literally they got the letter on a friday and were married on a monday.

    So here is my question, I heared that there is at least a 1 year wait for those who are deported to re-enter Canada just for a visit and I heared that after that 1 year period is when my fiancee's mothers paperwork will START being processed while she and her family remain in Sri Lanka making it all last for close to 18 months. Yet I heared elsewhere that it will only be 6 - 9 months and there will be no 1 year wait period first.

    However I have also been told that if I marry my fiancee in Sri Lanka (whom I met and became engaged to well before the deportation order out of love and not necessity) then after the 1 year period she will be able to return and will NOT have to wait for the 6 - 9 month sponsorship period in sri lanka, she goes thru that process here in canada with me. So I am just wondering what, if any of this information is true. I am meeting a supposedly very good immigration lawyer this week, and in the mean time I am curious as to whether any information I have been told so far is true. Her and her family were just unfortunate victims of bad advice from lawyers just wanting more money and telling them the wrong options.

    None of them have EVER been convicted of a criminal offence ever, my Fiancee herself is a Nursing Student at York University, her brother is almost done highschool (which he couldnt finish due to being deported) Also her mother works in a hotel as does her new step father (which is where they met) and to top it all off they own a house and have never EVER asked for a loan from the govt. I know this is a LONG and confusing situation, but ANY information would be GREATLY appreciated!     This is a U.S.-focused forum, and I'm not sure how likely it is that somebody here will know the details of Canadian immigration law. You may wish to try looking for a forum focused on Canadian legal issues.

    Ohh....ok I thought it was both due to a few posts I seen from people who said they are Canadian...I guess I didnt read it carefully enough. Thanks for the reply.
