so my 23 year old brother mad the choise to sex with his 16 year old girlfriend and well as life happens her parents found out and the father is threatening to press charges can he do this in the state of Michigan or is he just bolwing hot air? also if she changes her consenting sex to a rape to make daddy happy how deep in is my brother?

The girl is a minor..your brother is an adult...It isn't hard to figure out adults shouldn't be having sex with minors.

but in Michigan is not the age or consent 16? so the only danger is if she changes her mind about the consent part of their sex.

If she says there was no consent, then the man who raped this child could be held criminally liable (meaning, he will go to the clink).

750.10a Sexually delinquent persons; definition.

Sec. 10a.

The term “sexually delinquent person” when used in this act shall mean any person whose sexual behavior is characterized by repetitive or compulsive acts which indicate a disregard of consequences or the recognized rights of others, or by the use of force upon another person in attempting sex relations of either a heterosexual or homosexual nature, or by the commission of sexual aggressions against children under the age of 16.

As long as she does not change her story about consent, your brother should be ok. But I would sure have a talk with him about "dating at or near the age of consent. Its just not worth the time and money to have to defend oneself.
