Default Fence Line and Building Setbacks in Kansas

Our fence sits 18" over the property line of our neighbor's property. It's been that way for 25 years. Now the neighbor wants to build an addition to his home, but he's concerned that his side yard setback limits will be calculated from the fence line instead of his actual property line. He doesn't mind the fence unless it will affect his ability to utilize the full setback limits. Will it?

That will be a determination to be made by the codes enforcement office. You will just have to see what they say.
