Default Cosigner Wants To Take Car From Co-Owner Who Is Making Timely Payments
I have a question concerning this subject and I don't know exactly how to post it so I will try here.

Me and my husband co-signed on a loan for my niece. My husband's name is listed first, then mine, then hers. The car company suggested we list that we all live at the same address, which is ours since we own our home. Certain things that have happened have caused us to totally mistrust my niece and she is living somewhere else now. Our condition to her was that we have a key in case she doesn't make the payments and we can take the car. I don't want it ever to get out of hand and start having late payments so I'm wondering can we take the car from her and since we would be upside down in the car right now, we could keep it and just make the payments ourselves and not sell it. Is this legal, can we do this? Please help somebody???? Kansas is the state we reside in.

I know on the loan it was my husband's name first, then mine, then hers, so would the loan company give me that information. Would the title be different then how it's listed on the loan papers?

The title may well be different. If she's the only owner, it's her car and if you take it you would be stealing it.

Does anyone know where I can get that information of how our names are listed on the title? Would the finance company tell me this?

I just called the finance company and they said that my husband's name was listed first and then mine, they didn't even mention my niece's name. I know she had really bad credit with several reposessions so now I'm wondering if they even put her name on it.

Thanks so much for answering my questions. She's only had the car a couple of months, but I'm hoping to cut our losses and have it before it's unrepairable and worth nothing.
