    Default Moving To Another Country While On Probation

    My nephew wanted to study in europe. Everything is okay, he gets financial support from his father, has a place to live, even a job and he could start in October. But now he has been sentenced to 3 years of probation. Will he be allowed to leave the country, even if it's on bail? What if he wants to go back to the USA for vacation and for visiting his parents (christmas). is there any chance for him to come to europe without risking never to be able to go home anymore?

    If he jumps bail or skips out on probation, he will forever be a fugitive. This status may also get him kicked out of the country he is visiting as other countries tend to frown on accepting fleeing criminals within their borders. If he is not summarily removed, it is likely that his visa would not be renewed when it was up. No nation in Europe allows anyone to stay without proper and valid paperwork.

    Life as a fugitive can be a hard one. It's up to him if he wants to live like that.

    Hi Carl,

    we are looking for a legal way. He has a spanish passport on his mother's side, but he doesnt want to risk his American passport. I just want to know how big chances are that he will be allowed to study in europe.

    I have a question similar to this one.

    I was recently arrested in december of 2006, after my 28 year old brother attacked me and I tried to defend myself with a knife (You see last time he attacked me I ended up hospitalized.) and I called to cops to have him arrested for both being on Meth and attacking me, but since I wielded a deadly weapon and he got 3 little cuts, I GOT ARRESTED =/. The cops acted like they didn't notice my injuries, which were horrible bruises on my face, and a knot on the back of my head the size of a grapefruit =/.

    I was arrested and charged with Assault with A Deadly Weapon With Intent To Cause Great Bodily Injury.

    I went to court and all that, and since it was my first ever offense I got a good plea bargain from the DA, and took it. (I was thinking about fighting the case because of the hospital records of previous injuries I suffered during attacks from him, but my Public Defender said if I lost the case, I could get anywhere from 3-7 years PRISON TIME....)

    I pled No Contest and they dropped it from a felony to a misdemeanor, got time served (ten days), $100 restitution/fine, a 3 year -100 yard restraining order against me for my brother (like he needs it) and 3 years summary probation.

    Now my question, or issue rather, is this:

    My brother is coming back from West Virginia to live here in my family's house, and I don't want to risk being hurt or thrown into jail or prison for being near him. I was wondering if since I'm just on summary probation, if I can leave the state I'm in (California) to go live with a friend of mine in Iowa. I have a meeting with my judge tomorrow to discuss the possibility of me leaving the state and whatnot, but I'm so scared they'll say no, and I have no where else in this state to go (I only turn 19 in October)

    Do you guys have any suggestions on this matter? I'm desperate as I only have a week until he gets back.
