    Default Does a Show Cause Close a Case, in New York

    I was a Defendant in a Show Cause hearing. I won. The Plaintiff, immediately after losing, served me with a Summons, WITH THE SAME INDEX NUMBER AS THE SHOW CAUSE, continuing the action.

    Did that Show Cause ruling in my favor "retire" that case/Index Number, and would nullify the Summons, brought under that same Index number?

    There is no obvious reason why a "show cause" hearing would end a case. But we know absolutely nothing about the underlying litigation, so all we can do is guess as to its status. Ask the Clerk of the Court, or consult a lawyer.
