    Unhappy Quit Claim Deeds After Separation in Alabama

    My estranged husband and I have been separated since Sept. 23,2004 without any hesitation he met me at the bank and signed quit claim deeds to two properties we owned and one my brother has financed through one of my homes which made a total of three properties. He had a few days to back out but he cheerfully met me at the bank on Sept. 29,2004 and signed all quit claim deeds.. I even included one dollar to pay to him for each property which he took.
    This property has been in my name only since I filed it in the courts. Hes not payed for any maintance or landtaxes on either property.
    The reason he left was he had found his ole girlfriend and abandoned his family for her family we were married 17 years.
    I want my divorce is there anyway I could lose my properties when I go after my divorce. He has lived with this woman since he left our home.
    He has bought his dads lake property of 1/2 acre and his brothers trailer since he has left.
    I don't want anything except what we agreed to in the seperation agreement we signed and had noterized at the bank.

    If your husband cheerfully quitclaimed the properties over to you, why do you believe he will dispute the conveyance?

    In any case, your divorce lawyer can seek to enforce your separation agreement as governing the distribution of the marital estate. Your ex- may attempt to dispute its terms or validity. If the distribution of assets is fair and the agreement is in a legally proper form, I suspect that the judge will be inclined to uphold it.

    Because he is living with a woman who has never worked for anything in her life, she is on ssdi and living with him. she and her hillbilly sounding mother, since we haven't divorced due to my being disabled and it was in our seperation agreement he would maintain insurance on me. Is now trying to get him to go to court and try and take back some of the property.
    He has a trailer on the lake that he told me was paid for from his dad a trailer from his brother. His mother said it wasn't in his name yet.
    All I want now is for him to give me my divorce which we outlined in the seperation agreement which the courts wouldn't take, but we divided our property up Sept. 29, 2004 which was noterized.
