Hello I accepted a job offer and gave my two weeks notice at my old job.
At my new place of employment I started employment Tuesday July 17th, 2007. Upon arrival of my employment I had no desk and or office. I was hired as a software developer. I had my computer installed on the 18th and my office and desk on the 19th of July. I went to 3 meetings and attended the human resource orientation. I had extreme difficulty reaching the human resource people on the 18th due to the fact the HR manager was at a seminar. I needed to suppply my green card. The individual the was to be working with me gave me the "idea" that I was to report to her. Yet HR indicated I was to report to the IT Director. Anyway long story short. I had questioned some things with the indivudual and that was about it. I explained that I was confused about who to report to. That was the only hiccup.
I finally on Friday July 21 given the information of my green card and then was told that my employment was terminated. I was given a paycheck and no termination letter nothing. I asked why I was being terminated and they solely indicated that I was not a good fit. Also that I did not gel in well.
I took my belongings and was escorted out the building. I am applying for unemployment. I have done nothing wrong. Nothing unethical, not late or anything wrong, I followed the lead of the employee. I am a working professional of 18 years in the IT industry. I spoke about this with some people and this does happen. I fully understand the employee at will law in MA.
To cut to the chase of all this. I know that the company must indicate I conducted misconduct to be denied benefits. Is it solely based on what the company says. Isn't some sort of physical evidence required?? I am extremely confused by all of this so please any info would help tremendously. By the way when I applied for UI they indicated that this happens all the time.
Thanks
