Default Harassment After Late Payments
My friend got a loan with Lobel financial in Anaheim CA. some time ago, and he was late on a payment. ever since then He, myself, and at least 8 other people have been getting phonecalls at least 3 time a week from them. Even his work. Now he only gave them three refrences, so how could they get everyone elses numbers? and they have even called us from fake numbers. i got a call from them from my own number once. How is that possible?

They have a way to change numbers around so it looks like someone is calling you from your job or house. When really it's them calling. This should not be legal.

we have asked for them to stop calling but they don't. I asked the man's name, but I have a strong feeling its fake.

My friend made a partial payment (more than 80% owed) and his bank account said they took the payment, but they still call us constantly. I thought they couldn't.

what can I/we do?

Right - why are they calling you & the other people? --- to have you give him a message they called, to verify his address/phone#, to ask where he works . . . . .

well, they keep calling asking if we'd seen or heard from him and where they can find him. my friend put 3 of us as refrences about 2 years ago. but some of the people they called havn't talked to him in several, so its odd how they got their number, but they still call back. the rest of us tell them the only number and adress we know of, and they still call back. they even sent someone to his work, but he wasn't there at the time.

my friend is still making payments though. its not like he's not paying at all. whenever he pays they have some new "intrest" or "late penalty" so he can't catch up.

plus whatever problem they have, its with Him, not us. its like they've been stealing the numbers from his phonebill and calling all of them--constantly

If this is an in-house collection agency, they seem to revel in the fact that they are not covered by the FDCPA. The problem also seems to be exacerbated by the fact that your friend can't bother to pay his bills on time, so that each month or so they treat it as a "new collection matter" and start this cycle all over again. The easiest way to resolve this would be for your friend to stop paying late. The second-easiest, for him to pay off or refinance the loan. Beyond that, I suspect that the only way you're going to be able to get this company to stop calling you every time your friend is late is by taking legal action, and I'm not sure from what you've stated so far if you would have a viable case.

Ca. debt collection laws also apply to original creditors not just coll. agencies. You might want to contact the consumer affairs office of your state attorney general's office to clarify your rights.
